Political persuasion can express moral respect. In this article, however, I rely on two psychological assumptions to argue that political persuasion is generally prima facie disrespectful: (1) that we maintain our political beliefs largely for non-epistemic, personal reasons and (2) that our political beliefs are connected to our epistemic esteem. Given those assumptions, a persuader can either ignore the relevant personal reasons, explicitly address them, or implicitly address them. Ignoring those reasons, I argue, constitutes prima facie (...) insensitivity. Explicitly addressing them constitutes a form of prima facie incivility. Finally, implicitly addressing them covertly treats those personal reasons as psychological puppet strings, constituting prima facie objectionable manipulation. This prima facie insensitivity, incivility, and manipulation are each prima facie failures of respect, either for the persuadee’s rationality or for their agency. Political persuasion can sometimes be all-things-considered justified, but these moral hazards can produce reasonable guilt, resentment, and blowback. (shrink)

Sir David Ross introduced prima facie duties, or acts with a tendency to be duties proper. He also spoke of general prima facie principles, wwhich attribute to acts having some feature the tendency to be a duty proper. Like Utilitarians from Mill to Hare, he saw a role for such principles in the epistemology of duty: in the process by means of which, in any given situation, a moral code can help us to find out what (...) we ought to do.After formalizing general prima facie principles as universally quantified conditionals I will show how seeming duties can be detached from them. There will be examples involving lies, burnt offerings and the question of whether to have a napkin on your lap while eating asparagus. Some conservation biologists invoke the concept of ‘genetic integrity,’ which they generally assume is a good worth preserving without explicit justification. We examine the question of whether or not there is a prima facie duty to preserve genetic integrity in conservation biology. We examine several possible justifications for the potential duty found in the conservation biology literature. We argue, contra a dominant trend of thought in conservation biology, that there is no prima facie duty to preserve (...) genetic integrity and that any moral obligation to preserve genetic integrity in specific cases is merely derivative of other possible duties. Raanan Gillon is a noted defender of the four principles approach to healthcare ethics. His general position has always been that these principles are to be considered to be both universal and prima facie in nature. In recent work, however, he has made two claims that seem to present difficulties for this view. His first claim is that one of these four principles, respect for autonomy, has a special position in relation to the others: he holds that it (...) is first among equals. We argue that this claim makes little sense if the principles are to retain their prima facie nature. His second claim is that cultural variation can play an independent normative role in the construction of our moral judgments. This, he argues, enables us to occupy a middle ground between what he sees as the twin pitfalls of moral relativism and moral imperialism. We argue that there is no such middle ground, and while Gillon ultimately seems committed to relativism, it is some form of moral imperialism that will provide the only satisfactory construal of the four principles as prima facie universal moral principles. In modern German ‘Anschauung’ is translated as intuition. But in Kant’s technical philosophical context, it means an intuition derived from previous visualizations of physical processes in the world of perceptions. The nineteenth century chemists’ predilection for Kantian Anschauung led them to develop an intuitive representation of what exists beyond the bounds of the senses. Molecular structure is one of the illuminating outcomes. (Ochiai 2021, pp. 1–51) This mental habit seems to be dominant among chemists even in the twentieth century, as (...) is illustrated by the electronic theory of organic chemistry and the frontier orbital theory as well. The former assumes that (1) bonds are paired electrons shared by bonded atoms—in fact, electrons in molecules are not localized in bonds; (2) the difference of electronegativities between bonded atoms causes electron drifts—expressed by the curly arrow—that result in bond formation or bond cleavage. The latter focuses on the orbitals that make the greatest contribution to the energy of a system undergoing electron delocalization, while the LCAO method says, as is suggested by the word Linear Combination of Atomic Orbitals, molecular orbitals should be constructed from all of the atomic orbitals that have the appropriate symmetry. In other words, every molecular orbital contributes to some extent to the electronic state of a molecule. The curly arrow in the electronic theory and the orbital lobe in the frontier orbital theory illustrate an intuitive character of these theories. Although both theories rely on such simple and qualitative models rather than mathematically rigid quantum mechanical calculations, they are successful in explaining, predicting, and designing chemical reactions. What makes these prima facie intuitive theories so successful? In this study we address this problem from a historical and philosophical as well as scientific point of view. The key to solve this problem is that they are concerned with only bond formation or bond cleavage, in which the localized-bond principle holds. (shrink)

This contribution explores Wolfgang Pauli's idea that mind and matter are complementary aspects of the same reality. We adopt the working hypothesis that there is an undivided timeless primordial reality (the primordial 'one world'). Breaking its symmetry, we obtain a contextual description of the holistic reality in terms of two categorically different domains, one tensed and the other tenseless. The tensed domain includes, in addition to tensed time, nonmaterial processes and mental events. The tenseless domain refers to matter and physical (...) energy. This concept implies that mind cannot be reduced to matter, and that matter cannot be reduced to mind. The non-Boolean logical framework of modern quantum theory is general enough to implement this idea. Time is not taken to be an a priori concept, but an archetypal acausal order is assumed which can be represented by a one-parameter group of automorphisms, generating a time operator which parametrizes all processes, whether material or nonmaterial. The time-reversal symmetry is broken in the nonmaterial domain, resulting in a universal direction of time for the material domain as well. (shrink)

The behaviour of autonomous agents may deviate from that deemed to be for the good of the societal systems of which they are a part. Norms have therefore been proposed as a means to regulate agent behaviours in open and dynamic systems, where these norms specify the obliged, permitted and prohibited behaviours of agents. Regulation can effectively be achieved through use of enforcement mechanisms that result in a net loss of utility for an agent in cases where the agent’s behaviour (...) fails to comply with the norms. Recognition of compliance is thus crucial for achieving regulation. In this paper, we propose a general framework for observation of agents’ behaviour, and recognition of this behaviour as constituting, or counting as, compliance or violation. The framework deploys monitors that receive inputs from trusted observers, and processes these inputs together with transition network representations of individual norms. In this way, monitors determine the fulfillment or violation status of norms. The paper also describes a proof of concept implementation of the framework, and its deployment in electronic contracting environments. (shrink)

Natural kind terms have exercised philosophical fancy ever since Kripke, in Naming and Necessity, claimed them to be rigid designators. He there drew attention to the peculiar, name-like behavior of a family of prima facie loosely related general terms of ordinary English: terms such as ‘water’, ‘tiger’, ‘heat’, and ‘red’. Just as for ordinary proper names, Kripke argued that such terms cannot be synonymous with any of the definite descriptions ordinary speakers associate with them. Rather, the name-like behavior (...) of these so-called natural kind terms is to be explained, just as in in the case of proper names, by the doctrine of rigid designation. And as a consequence of thus extending the notion of rigid designation to general terms, he famously endorsed the claim that so-called ‘theoretical identifications’, i.e. statements like (1) Water is H2O, are necessary, if true. There are many uses in English of the word “ought” (see Ought). This essay concerns the normative uses and the concepts or properties denoted thereby. In particular, it concerns two nonfinal oughts commonly used in the philosophical literature: prima facie oughts and pro tanto oughts.

Perception is said to have assertoric force: It inclines the perceiver to believe its content. In contrast, perceptual imagination is commonly taken to be non-assertoric: Imagining winning a piano contest does not incline the imaginer to believe they actually won. However, abundant evidence from clinical and experimental psychology shows that imagination influences attitudes and behavior in ways similar to perceptual experiences. To account for these phenomena, I propose that perceptual imaginings have implicit assertoric force and put forth a theory—the (...) class='Hi'>Prima Facie View—as a unified explanation for the empirical findings reviewed. According to this view, mental images are treated as percepts in operations involving associative memory. Finally, I address alternative explanations that could account for the reviewed empirical evidence—such as a Spinozian model of belief formation or Gendler’s notion of alief—as well as potential objections to the Prima Facie View. This paper presents a nonmonotonic deontic logic based on commonsense entailment. It establishes criteria a successful account of obligation should satisfy, and develops a theory that satisfies them. The theory includes two conditional notions of prima facie obligation. One is constitutive; the other is epistemic, and follows nonmonotonically from the constitutive notion. The paper defines unconditional notions of prima facie obligation in terms of the conditional notions.

The purpose of this paper is to critically engage with a recent attempt by Thom Scott-Phillips to offer a general account of communication. As a general account, it is intended to apply equally well to both non-human and human interactions which are prima facie communicative in character. However, so far, Scott-Phillips has provided little detail regarding how his account is supposed to apply to the latter set of cases. After presenting what I take to be the most plausible (...) way of filling in those details, I argue that his account would appear to be too narrow: it fails to capture a range of human interactions which strike us as instances of communication. To wit, these are cases in which some but not all of the information an act is designed to convey to a reactor actually reaches that reactor. An alternative account incorporating Scott-Phillips’ main insights is then sketched, and it is suggested that this account, or something like it, would accommodate the full range of non-human and human interactions that are intuitively communicative. Rules stating principles or purposes are always applied as views determining the decision by weighing (but not by subsumption) so that the problem of prima facie validity does not arise. Any theory of reduction that goes only so far as carried in Parts I and II does only half the job. Prima facie at least, there are cases of would-be reduction which seem torn between two conflicting intuitions. On the one side there is a strong intuition that reduction is involved, and a strongly retentive reduction at that. On the other side it seems that the concepts at one level cross-classify those at the other level, so that there (...) is no way to identify properties at one level with those at the other. There is evidence to suggest that there will be no unique mental state/neural state association that can be set up, because, e.g., many different parts of the nervous system are all capable of taking over ‘control’ of the one mental function. And it is alleged that infinitely many, worse: indefinitely many, different bio-chemo-physical states could correspond to the economic property ‘has a monetary system of economic exchange’; and similarly for the property ‘has just won a game of tennis’. Yet one doesn't want an economic system or a game of tennis to be some ghostly addition to the actual bio-chemo-physical processes and events involved. Similarly one hopes that neurophysiology allied with the rest of natural science will render human experience and behaviour explicable. (shrink)

Accretive and monotone operator theory are central branches of nonlinear functional analysis and constitute the abstract study of certain set-valued mappings between function spaces. This paper deals with the computational properties of these accretive and (generalized) monotone set-valued operators. In particular, we develop (and extend) for this field the theoretical framework of proof mining, a program in mathematical logic that seeks to extract computational information from prima facie “non-computational” proofs from the mainstream literature. To this end, we establish (...) logical metatheorems that guarantee and quantify the computational content of theorems pertaining to accretive and (generalized) monotone set-valued operators. On the one hand, our results unify a number of recent case studies, while they also provide characterizations of central analytical notions in terms of proof theoretic ones on the other, which provides a crucial perspective on needed quantitative assumptions in future applications of proof mining to these branches. This paper deals with some problems concerning the logical treatment of prima facie obligations in the work of Carlos Alchourrón. On the one hand, we will argue that his DFT system for defeasible conditionals does not adequately formalize the intuitive notion of contributory condition used by Alchourrón to elucidate the notion of defeasible conditional. One of the streams in the early development of set theory was an attempt to use mereology, a formal theory of parthood, as a foundational tool. The first such attempt is due to a Polish logician, Stanisław Leśniewski . The attempt failed, but there is another, prima facie more promising attempt by Jerzy Słupecki , who employed his generalized mereology to build mereological foundations for type theory. In this paper I situate Leśniewski's attempt in the development of set (...) theory, describe and evaluate Leśniewski's approach, describe Słupecki's strategy without unnecessary technical details, and evaluate it with a rather negative outcome. The issues discussed go beyond merely historical interests due to the current popularity of mereology and because they are related to nominalistic attempts to understand mathematics in general. Until recently, it was widely assumed in societies with long-established, publicly funded school systems that school attendance served the interests of children, society, and parents alike. In the United States and other common-law jurisdictions, safeguarding and promoting the independent welfare and developmental interests of every child was a public responsibility under the parens patriae doctrine. Compulsory schooling laws enacted under parens patriae authority required all persons having care and control of a child to share their custodial authority with publicly certified (...) teachers for limited periods of time. By compelling all parents to send their children to school, the state ensured that all children had access to instruction and opportunities for social, economic, and civic participation beyond what their parents alone could provide. Parents were incidentally freer to manage the competing demands of domestic life and paid employment, and the enforcement of child labor laws was greatly facilitated by efforts to ensure school attendance. While compulsory schooling laws imposed obvious limits on the custodial authority of all parents for the sake of all children, they were rarely challenged on that basis. Not so today. (shrink)

The paper argues that the idea of prima facie rights implies insurmountable difficulties in connection with the function such rights are said to have in a scheme of justice. G vlastos's version of prima facie rights theories is scrutinized as typical and more advanced than others. The paper shows that natural rights are contextually absolute; they cannot (morally) be overruled in a context of normal political circumstances but may have to be disregarded whenever politics is impossible. Even when a person appears to have consented to another’s interference with her interests, we sometimes treat this apparent consent as ineffective. This may either be because the law does not permit consent to validate the actions concerned, or because the consent is undermined by the presence of additional factors which render it insufficiently autonomous to be effective. In this paper I propose that the project of categorising and systematically analysing the latter set of cases, would be furthered by recognising (...) (1) that prima facie consent is undermined when the prima facie consenter’s autonomy to choose whether or not to consent has been unfairly constrained, and (2) that theoretical and doctrinal clarity can be promoted by analysing the factors that unfairly constrain autonomy in the criminal law using a framework developed in contract law to determine analogous questions arising in relation to assent to a contract. W. K. Clifford famously argued that it is “wrong always, everywhere and for anyone, to believe anything upon insufficient evidence.” Though the spirit of this claim resonates with me, the letter does not. To wit, I am inclined to think that it is not morally wrong for, say, an elderly woman on her death bed to believe privately that she is going to heaven even if she does so on insufficient evidence—indeed, and lest there be any confusion, even if the (...) woman herself deems the evidence for her so believing to be insufficient. After all, her believing so does not appear to endanger, harm, or violate the rights of anyone, nor does it make the world a worse place in a significant, if any, way. That Clifford might have put too fine a point on the matter, however, does not entail that there are no conditions under which it is wrong to believe something upon insufficient evidence. In this paper, I argue that, in cases where believing a proposition (read: believing a proposition to be true) will affect others, it is prima facie wrong to have propositional faith—for present purposes, to believe the proposition despite deeming the evidence for one’s believing to be insufficient—before one has attempted to believe the proposition by proportioning one’s belief to the evidence. I argue that colleges should include philosophy courses as general-education requirements. I begin by explaining the prima facie case against general-education requirements and the need for philosophers to defend their courses’ place in the general-education curriculum. Next, I present two arguments for philosophy as a general-education requirement. The first is the Argument from Content: that philosophy courses’ content tends to match the intended nature and purposes of general-education courses. The second is the Argument from Outcomes: that even if (...) philosophy courses didn’t match the intended purposes of general-education courses, they would still be appropriate as general-education requirements, because there is empirical evidence that philosophy courses produce valuable skills and knowledge in students. In The Right and the Good, W. D. Ross commits himself to the view that, in addition to being distinct and defeasible, some prima facie duties are more binding than others. David McNaughton has argued that there appears to be no way of making sense of this claim that is both coherent and consistent with Ross's overall picture. I offer an alternative way of understanding Ross's remarks about the comparative stringency of prima facie duties, which, in (...) addition to being compatible with his view as presented in the text, provides us with a coherent, and indeed plausible, account of what it means for some duties to be more binding than others.
